This RIMS eLearning Management System including any services offered through this system (“System”) is offered to the user conditioned on acceptance by the user (“User”, “You”, or “Agency”) without modification of the terms, conditions, and notices contained herein. By accessing and using this System, the User agrees to be bound to all such terms, conditions, and notices, including but not limited to the Policy (the “Agreement”).
Use of System
User represents and warrants that he or she possesses the legal right and ability to enter into this Agreement and to use this System in accordance with all terms and conditions herein. User agrees not to assign, transfer, or sublicense User rights pursuant to this Agreement. User shall be completely responsible for any and all charges, fees, duties, taxes, and assessments arising out of the use of this System.
The System is provided for the User’s use only and the User agrees not to modify, reverse engineer, reproduce, duplicate, copy, sell, transfer, resell or exploit for any use, or access to the System.
Copyright and Trademark Notices
Copyright® 2021 Sun Ridge Systems, Inc. All trademarks displayed on the System are the property of their respective owners. The copyrights, trademarks, trade names, logos, and service marks (“Marks”) displayed on the System are Sun Ridge Systems, Inc. property or the property of other third parties. You are not permitted to use these Marks without Sun Ridge System’s prior written consent or the consent of such third parties that may own the Marks.
Liability Disclaimer
The information, software, products, and services published on this System may include inaccuracies or typographical errors. Changes are periodically added to the information on the System. Sun Ridge Systems, Inc. may make improvements and/or changes to this System at any time. Sun Ridge Systems, Inc. makes no representations about the suitability of the information, software, products, and services contained on this System for any purpose. All such information, software, products, and services are provided “as is” without warranty of any kind. Proprietary Rights
All information, documents, products, and software (the “Materials”) provided in connection with the System are owned by Sun Ridge Systems, Inc. and are the intellectual property of Sun Ridge Systems. Except as stated herein, none of the Materials may be copied, reproduced, resold, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise. Users also may not “mirror” any material provided with this System on any other server. Nothing provided through the System shall be construed as granting or conferring any license, patent, copyright, trademark, or other proprietary rights to the User. Any unauthorized use of any Materials provided with or through this System may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. Sun Ridge Systems, Inc. reserves the right to investigate any illegal and/or unauthorized use of the System and to take appropriate legal action, including, without limitation, civil, criminal, and injunctive redress.

User is responsible for any fees for Third Party Services that result from User’s access to or use of such Third-Party Services.
Software Available on this System
Please note that all software, including without limitation all HTML code and Active X controls contained in this System, is owned by Sun Ridge Systems, Inc. and/or its service providers and is protected by intellectual property and other laws, including without limitation copyright laws and international treaty provisions. Any reproduction or redistribution of such software is expressly prohibited by law and may result in civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
Indemnity
As a condition to using this System, the User agrees to indemnify Sun Ridge Systems, Inc. from and against any and all liabilities, expenses (including attorney’s fees), and damages arising out of claims resulting from User’s use of this System, including without limitation any claims alleging facts that if true would constitute a breach by User of this Agreement.
Acceptable Use and Conduct
The System is intended to provide basic and advanced training for personnel of RIMS agencies that are actively licensed to use RIMS. To the extent that this System contains or generates bulletin boards, chat rooms, surveys, feedback forms, or other communication facilities (“Forums”), the User agrees to use such forums only to send and receive messages and material that are proper and related to the particular forum. By way of example, and not as a limitation, the User agrees that when using a forum, the User shall not:
- Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
- Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent, or unlawful material or information.
- Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless the User owns or controls the rights thereto or has received all necessary consents.
- Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.
- Delete any author attributions, legal notices or proprietary designations, or labels in any file that is uploaded.
- Falsify the origin or source of software or other material contained in a file that is uploaded.
- Advertise or offer to sell any goods or services, or engage in surveys, contests, chain letters, or for any commercial purpose.
- Download any file that the User knows, or reasonably should know, cannot be legally distributed via this System.
User is prohibited from using the System to publish, submit, copy, upload, download, post, transmit, reproduce, or distribute software, video or audio content, or any other material that is protected by copyright, trademark, patent, trade secret, or any other type of intellectual property rights that belongs to a third party unless User has received all necessary permissions.
User agrees to use this System only as permitted by this Agreement, any additional policies or procedures published in this System from time to time by Sun Ridge Systems, Inc. and applicable law. Sun Ridge Systems, Inc. reserves the right for any reason to remove without notice any contents of this System received from users. Sun Ridge Systems, Inc. reserves the right to deny in its sole discretion any user access to this Portal or any portion thereof without notice. Sun Ridge Systems, Inc. reserves the right to edit any notices or postings for clarity and length. The User acknowledges that any Forums hosted by this System are public and not private communications. Further, the User acknowledges that postings and other communications by other users are not endorsed by Sun Ridge Systems, Inc. and such communications shall not be considered reviewed, screened, or approved by Sun Ridge Systems, Inc.
General
Sun Ridge Systems, Inc. reserves the right to make any and all changes to this System at its sole discretion without notice to the User. Sun Ridge Systems, Inc. reserves the right to deny access to this System to anyone at any time. This Agreement shall be deemed to include all other notices, policies, disclaimers, and other terms contained in this System; provided, however, that in the event of a conflict between such other terms and the terms of this Agreement, the terms of this Agreement shall control.
The instruction given on this website is the expressed direction of Sun Ridge Systems, Inc. based on the design and feature of the applications. Your agency/company may utilize the software applications in a manner contrary to the instruction given here. The user must seek the guidance of the agency system administrator(s) for final direction.
Any rights not expressly granted herein are reserved.
